This Privacy Policy is part of our Terms of Service. Capitalized terms not defined in this Privacy Policy have the meaning set forth in the Terms of Service located at www.flyyourvision.com/terms.

Fly Your Vision B.V. ("Fly Your Vision", "we", "our" or "us"), a private limited liability company registered with The Netherlands Chamber of Commerce (KvK 88175561), knows your privacy is important to you.

This Privacy Policy describes what personal data we collect, how we use it, with whom we share it, your rights and obligations with respect to your personal data as well as our other views and practices regarding your personal data. Under applicable law, Fly Your Vision B.V. is the data controller of your personal data.

Before you use or submit any personal data through or in connection with our Services, please carefully review this Privacy Policy.

By using or accessing our Services, you consent to the terms as set forth in this Privacy Policy now and as amended by us in the future.

What personal data we collect

In principle, we only collect the minimum amount of personal data that we need to provide you with our Services. We do not automatically collect personal data that can be personally identifiable to you from your use of our Services. This means that, unless otherwise stated, the personal data that you provide through your use of our Services is not collected by us, is retained locally on your device where applicable, or is converted into anonymous or aggregated data by removing personal data that makes the data personally identifiable to you.

We will collect and process the following (personal) data from you:

  • Personal data directly provided by you. We may collect personal data from you in a variety of ways, including:

    • Personal data and information you provide us voluntarily;
    • When you communicate with us, we keep that correspondence including your email and name where applicable;
    • When you participate in written responses to surveys or feedback, we will keep the information you provide us;
    • When you send us a CV, resumé or other details of your employment history in connection with an advertised job vacancy or a general inquiry regarding employment opportunities with us, we will retain your name, contact details and employment details;
    • When you subscribe to a newsletter, we will collect your email and name.
  • Data that is automatically collected. Data that we automatically collect is not personally identifiable to you. In some cases we may link this automatically collected data to other data we collect about you in order to improve our Services and our marketing offers to you. Data we automatically collect includes:

    • Technical data. We may collect information about the devices you use to access our Services. This includes, but is not limited to, the type of device you use, the IP address of your device, your operating system, application version and your language settings.

    • Engagement data. We may collect information about the way you interact and engage with our Services. This includes, but is not limited to, the screens, pages, features and content that you use and when you perform certain actions such as purchasing content or progressing through content.

    • Activity data. We may collect information about your activity when using our Services. This includes, but is not limited to, the frequency, date, time and duration of your usage.

    • Transaction data. We may collect information about your transaction data regarding purchases you made through our Services, this includes the date and time you last used the purchased content and its receipt file or purchase token which serve as the verification of your purchase.

How we use your personal data

We use your personal data for the following purposes:

  • For the purposes for which you provided it;
  • For providing our Services to you;
  • For providing customer support and customer service;
  • For personalizing your experience of our Services;
  • For allowing you to monitor your performance and progress in our Services;
  • For research and development and to understand and improve our Services;
  • For communicating with you about our Services;
  • For marketing, promoting and driving engagement with our Services;

We may create aggregated and other anonymous data from your personal data. We make personal data into anonymous data by removing personal data that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties to operate, understand and improve our Services, develop new features, develop new Services and for other lawful business purposes.

As part of providing our Services we may send you announcements, updates and support related messages through our Services or by email if you provided us with your email. We may also send you reminder notifications on your mobile device if you opt in to these notifications.

You may opt out of any non-essential service emails at any time. You may also opt out from receiving reminder notifications on your mobile device at any time through your device settings or through the settings provided in our Services where applicable.

We may also use your email to send you notifications regarding new Services, offers and promotions offered by us if you affirmatively consent to receive such communications. You may opt out of these communications by following the opt out instructions in the message or through the settings provided in our Services where applicable. We do not provide your personal data such as your email to third parties for their own marketing purposes.

Lawful bases for use of your personal data

We will only use your personal data where we have lawful bases under applicable law. Our lawful bases include:

  • Consent. Where we obtain your consent for a specific processing purpose.

  • Contract. Where processing is necessary for the performance of a contract, for example when you want to use our Services. The same applies to such processing that are necessary for the performance of pre-contractual measures, for example if you enquire about our Services.

  • Legal compliance. Where we are subject to legal obligations that requires the processing of personal data.

  • Legitimate interests. Where processing your personal data furthers our legitimate business interests in ways that are not overridden by the impact on you unless we have your consent or our processing is otherwise required or permitted by law, such as, but not limited to, providing an enjoyable user experience meeting your expectations, customer service, marketing, protecting our users, personnel and property, analyzing and improving our business, processing job applications and managing legal issues.

  • Vital interests. Where in the event that vital interests of you or another natural person require the processing of personal data.

When we share your personal data

We may share your personal data with third parties only if this is necessary for the purposes described in this Privacy Policy, legally required, or if you have provided explicit consent beforehand.

We may share your personal data with, in case of or for:

  • Business affiliates. We may share your personal data with our business affiliates, such as entities under common ownership or control, in which case we will require those entities to honor this Privacy Policy.

  • Service providers. We may share your personal data with selected third parties that support our Services. These data processors include hosting, payment processing, analytics, diagnostics and email delivery service providers. We authorize these service providers to use your personal data only for providing their services and support functions to us in accordance with this Privacy Policy.   • Business transfers. We may sell, transfer or otherwise share some or all of our assets, including your personal data, in connection with an actual or contemplated merger, consolidation, acquisition, reorganization, business transaction or in the event of bankruptcy. In such scenarios, we will post a notice or otherwise notify you and collect your consent, as may be required by applicable law, well before any of your personal data is transferred and becomes subject to a different privacy policy.

  • Compliance with law, legal requests and protection of our rights. We will share you personal data when we are required to do so in order to comply with any legal obligations. We may also share your personal data in order to enforce or apply our Terms of Service or to protect the rights, interests, property, or safety of us, our users, or others.

Some of our service providers are based in the United States. Therefore your personal data might be transferred to third parties in third countries, depending on your country of residence. You fully understand and unambiguously consent to the transfer of your personal data to, and the collection and processing of such personal data in the United States.

How we retain, delete and secure your personal data

We retain your personal data for no longer than necessary for the purposes described in this Privacy Policy. The retention period therefore depends on the purposes for which we process it or as required to comply with applicable law.

Your personal data will be deleted if you revoke your consent to its retention, if it is no longer needed to fulfill the contract concerning the Services or if it becomes legally impermissible. If retention of your personal data is legally necessary, it will be retained as long as required by applicable law.

To dispose of your personal data, we may anonymize it, delete it or take other appropriate measures. Your personal data may persist in copies made for backup and business continuity purposes for additional time.

We have taken appropriate measures to protect your personal data from loss, unauthorized access, use, or disclosure. However, no method of transmission or retention is completely secure. We therefore cannot guarantee absolute security of the personal data we seek to protect.

Your rights with respect to your personal data

Where applicable by local law and subject to limitations and exceptions under applicable law, you have the following rights:

  • Right to know. You have the right to request confirmation about whether we process personal data about you. We outline what data we collect, as well as how we use it, in this privacy policy.

  • Right of access. You have the right to request access to the personal data we hold about you.

  • Right to rectification. You have the right to request rectification of your personal data or provide us with additional personal data in order to complete the collection of your personal data.

  • Right to erasure / "To be forgotten". You have the right to request the deletion of your personal data. If granted, subject to certain limitations under applicable law, we will delete the relevant personal data from our and our service provider's possession. Fulfillment of some data deletion requests may prevent you from using our Services and results in the termination of our Services to you.

  • Right to restrict processing. You have the right to request that we restrict the processing of the personal data we hold about you. If we agree with your request for restriction, we will not further process your personal data during the term of the restriction, unless permitted by applicable law. Note that we never have and never will sell your personal data.

  • Right to data portability. You have the right to request your personal data to be provided in a format that can be transferred electronically to a third party.

  • Right to object. You have the right to object at any time to the further processing of your personal data, including the right to object to marketing.

  • Right to complain. You have the right to make a complaint regarding our handling of your personal data with the appropriate supervisory authority. However, we encourage you to contact us first at support@flyyourvision.com and we will do our very best to resolve your concern.

  • Right to not be subject to automated decision-making. You have the right to object to and prevent any decision that could have a legal or similarly significant effect on you from being made solely based on automated processes. This right is limited if the decision is necessary for performance of any contract between you and us, is allowed by applicable law, or based on your explicit consent.

  • Right to withdraw consent. You can revoke the consent for future data processing at any time. We will then not further process your personal data for the purposes to which the consent relates. However, this does not affect the lawfulness of the processing based on the consent before your revocation. Should the processing of data be lawful due to another reason, we may continue to process your data based on these grounds.

  • Right to non-discrimination. We do not and will not charge you a different amount to use our products, offer you different discounts, or give you a lower level of customer service because you have exercised your data privacy rights. However, the exercise of certain rights may, by virtue of you exercising those rights, prevent you from using our Services.

You can exercise most of your rights directly through our Services, by updating, amending, correcting or deleting your personal data yourself.

To ensure that the request has been made by you, we ask for your identification. If an authorized agent is corresponding on your behalf, we will also need written consent with a signature from you before proceeding. We will respond to your requests within a reasonable timeframe.

It is possible that we refuse your request, for example because we (legally) cannot or do not have to comply with your request. Where this is the case, we will inform you of specific details in response to your request.

Additional information

We would like to inform you about the following privacy practices:

  • Consent to Share Consumption Data with Apple. By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

  • Links. Our Services may link to or integrate with other sites and services operated by third parties. These third parties might follow different practices regarding their collection, use and sharing of your personal data. We are not responsible for the privacy practices of such third parties and encourage you to read their privacy policies.

  • Cookies. We may use functional and analytical cookies within our Services that do not infringe on your privacy. They ensure that our Services work properly and, for example, remember your preferred settings. They also enable us to optimize and improve our Services. You can opt out of cookies by setting your device so that it no longer stores cookies. In addition, you can also delete previously stored cookies. However, doing so might prevent our Services to work correctly.

  • Do not track. We do not track your personal data over time and across third party websites to provide targeted advertising and therefore do not respond to "do not track" signals.

Changes to this Privacy Policy

We may update this Privacy Policy as needed to comply with relevant legislation and to reflect any new practices or Services. Whenever we make a significant change to our Privacy Policy, we will refresh the effective date at the top of this Privacy Policy and take any other appropriate steps to notify you.

Please note that, for existing users, unless otherwise provided by applicable law, your continued use of our Services following the effective date means that you agree with, and consent to be bound by, the updated Privacy Policy.
